Terms & Conditions

 

TERMS & CONDITIONS

All bookings accepted by us are subject to these terms and conditions

1 Booking procedure, payment terms and remittance

1.1 Guests should complete the enquiry form to check availability
1.2 All guests must complete and return the booking form and the terms and conditions of rental
1.3 All deposits to be paid by either credit or debit card (4% surcharge for credit card payments)
1.4 A booking will only be considered firm, when the £250 deposit has been paid and when we have confirmed the booking in writing to the guest
1.5 The balance is due eight (8) weeks before the date you arrive at the villa. No reminder will be issued
1.6 Bookings made within eight (8) weeks of departure are payable in full by credit or debit card only at the time of booking
1.7 A £200 per week is required as a security deposit (against loss or damage), which must accompany your final payment (this will be refunded in full not later than four (4) weeks following return home upon receipt of a satisfactory management report that there has been no loss or damage to the villa)
1.8 Minimum booking period is one week (7 days), unless special arrangements have been made at the time of booking
1.9 A 10% late payment surcharge will automatically apply if final payment is not made on time
1.10 A £25 surcharge will be applied if we do not receive your signed terms and conditions of rental at the time of booking

2 Cancellation

2.1 You may cancel the booking at any time after it has been confirmed, subject to clause 2.3 below
2.2 Cancellation must be in writing, we reserve the right to cancel the booking if payment has not been received in accordance with clauses 1.5 and 1.6 above
2.3 The following cancellation charges apply to all rentals cancelled in accordance with clauses 1.5 and 1.6 above:
2.31 any cancellation, loss of full rental deposit
2.32 within 20 weeks cancellation, 50% of total rental
2.33 within 16 weeks cancellation, 75% of total rental
2.34 within 12 weeks cancellation, 100% of total rental
2.4 The security deposit is not subject to cancellation charges and would be refunded in full
2.5 All cancellations are subject to a £25 administrative fee

3 Alterations by the guest

3.1 If once the booking has been accepted, the guest wishes to make any alterations to the booking detail, we will do all we can to assist you provided that the request is made in writing (e-mail is acceptable) by the person who has signed the booking form
3.2 Any alteration will incur an administrative fee of £25
3.3 Material alterations may be treated as a cancellation
3.4 Any alterations made less than nine (9) weeks before the date of arrival, may be treated by us as a cancellation and so subject to the cancellation charges, outlined in 2.3 above

4 Cancellations by us

4.1 In the unlikely event of cancellations by us, we will inform you as soon as reasonably practicable and fully refund you any monies you have paid

5 Accommodation

5.1 The villa provided is only for the number of persons indicated by the lead guest on the booking form at the time of booking. A £200 charge per day will be made per additional person, if we are not notified at least 14 days prior to travel of any change in the original numbers when the booking was accepted
5.2 Sub-letting, sharing, or assigning are strictly prohibited
5.3 The villa will be available to guests after 4.00 pm Florida time. Early arrival and late departure is strictly prohibited, failure to comply will result in the charge of an additional days rental and you will be asked to leave the villa immediately
5.4 The villa must be vacated by 10.00 am Florida time on the day of departure. (see 5.3 above)
5.5 An adult must accompany guests under the age of 21

6 Use of swimming pool and spa

6.1 Swimming pools and spas are dangerous and ours is not to be used by children without adult supervision
6.2 We will not be liable for any loss or injury resulting from the use of the villa and the pool and spa
6.3 No bubble bath or similar liquids are to be used in the pool and spa. You are required to shower or bath before you use the spa, especially if you have sun oil/lotion or sand on your body
6.4 For your own safety, glass or bottles are not allowed in the pool or spa
6.5 You will be liable for the full cost of any damage (including loss of rental income while any damage is repaired) if you do not adhere to the swimming pool and spa terms and conditions
6.6 Guests must not change or touch any pool / spa equipment
6.7 Guests must not change or touch the pool heater/pump control box
6.8 Guests must not change or touch the spa control box
6.9 Failure to comply with 6.6, 6.7 and 6.8 will result in the full loss of security deposit and you will be required to leave the home immediately
6.10 Any theft of pool heat or damage to any pool equipment will be reported to the Sheriff's department
6.11 Pool/spa heat is charged at weekly rates only
6.12 For the safety of all guests, a pool fence is provided at the property

7 Use of utilities

7.1 Normal usage of gas, water, telephone and electricity is included in the rental price
7.2 You will be subject to the full costs of any additional charges if utility and/or telephone bills for the period of your stay are in excess of 10% above normal usage
7.3 Cable TV is provided and is included in the rental price

8 Loss/damage/condition of home

8.1 Our management company will advise us of any loss or damage to the villa following your departure. They will also provide a full report on the general condition/cleanliness of the home. We expect guests to leave the home in a reasonable and tidy condition
8.2 We will be fully reimbursed by the lead guest for any loss or damage incurred during the duration of your stay. We will also be fully reimbursed by the lead renter for any additional cleaning costs as a result of their stay
8.3 Any loss, damage or cleaning fees costing in excess of the security deposit amount will be fully reimbursed by the lead guest within one week (7 days) of departure
8.4 Guests are required to remove their trash/rubbish from the villa. Failure to comply will result in a minimum charge of £50.

8.5 Any smoking at the villa, will result in the full loss of security deposit.

8.6 Any security deposit deductions, will automatically be subjected to an additional £25 administrative charge.

9 Insects and pests

9.1 Insects and pests are inevitably present in the Florida climate. Within reason, this is normal and we cannot take action to eradicate it
9.2 The villa receives periodic pest control treatment. Only when, in our reasonable opinion, pests in the living accommodation are a serious nuisance will further action be taken

10 Complaints

10.1 In the unlikely event that the guest has any reason for complaint or dissatisfaction, they must contact our management company, Oasis Vacation Homes on 407 944 9398, so that speedy and remedial action is taken
10.2 If the management company for any reasons deemed 'unjustified/unwarranted', a £50 charge per call out will be payable in advance

11 Passports and travel documents

11.1 Passports and visas are your personal responsibility
11.2 We make no representations and provide no advice, orally, in writing, or otherwise in relation to your passport or visa requirements to enter into and remain in the USA
11.3 You should confirm all passport and visa requirements with the American Embassy before booking the villa

12 Smoking

12.1 For the comfort and safety of guests, our property is non smoking, failure to comply will result in the full loss of your security deposit and you will also be subject to pay any additional cleaning/damage costs


13 Animals and pets

13.1 Animals and pets are not permitted on the property

14 Force majeure and liability limitation

14.1 We accept no responsibility for and shall not be liable in respect of any loss or damage or alterations, delays or changes arising from circumstances outside our control such as war or threat of war, fire or adverse weather conditions, government action, technical problems with transport, closure or congestion at airports, cancellations or changes of schedules by airlines, theft from the villa premises (both interior and exterior including garage, pool and spa areas) or mechanical/electrical failures that are beyond our control
14.2 In the event that weather conditions fall above fifty (50) degrees centigrade, the pool heating will automatically shut off to prevent damage. No refund will be given in this event
14.3 In the unlikely event of us being negligent and/or in breach of our contract with you, our liability shall be limited to the cost of your booking with us
14.4 We accept no responsibility in respect of any loss or damage for which you are, or should be insured or entitled to indemnity from any third party

15 Accuracy of information

15.1 A great deal of care has been taken to ensure the accuracy of information we have provided. However, facilities and services may not be open or available due to renovation/maintenance works, adverse weather etc. Where we are aware that a facility or service advertised in the information provided will not be available during the period of your stay, we will take steps, wherever possible, to notify you prior to travel. Some furniture may also differ to that advertised
15.2 We reserve the right to reasonably amend any of the terms and conditions set out herewith

16 Travel

16.1 All transportation by air, land or sea is subject to the terms and conditions of the company providing the transport and not us

17 Use of the Computer

17.1 Computer settings must not be changed at any time
17.2 The computer must not be used to access adult (ie pornographic) web sites
17.3 Children must be supervised at all times when using the computer
17.4 Failure to comply to the terms and conditions set out in 17.1, 17.2 and 17.3 will result in full loss of security deposit and loss of any rental income whilst repairs are being effected to remedy any damage

18 Governing law

18.1 The laws of the UK (for UK/European guests) and USA (for all other guests) shall apply to this contract and any other claims


Finally, we strongly recommend that you take out travel and medical holiday insurance to cover unforeseen circumstances which may necessitate the cancellation of your booking
